At MEGA MART CA, INC. (“MEGA MART,” “we,” “us,” “our”), we recognize and respect the importance of protecting our customers’ personal information. This Privacy Policy describes the categories of personal information we collect from and about you when you visit or make purchases through our website, how we use and share that information, how long we retain it, and the rights available to you — including the rights of California residents under the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”).
This Privacy Policy is incorporated by reference into our Terms of Service.
1. INFORMATION WE COLLECT
A. Information You Provide
We collect information that you voluntarily provide to us when you use our website, create an account, make purchases, subscribe to notifications, complete forms, participate in surveys or promotions, or contact us directly. This information may include:
- Identifiers: name, postal address, ZIP code, email address, telephone number, account username and password
- Commercial information: products purchased or considered, order history
- Payment information: payment card details, billing address (payment card numbers are processed by our payment processors and are not stored on our servers)
- Other information you voluntarily share, such as approximate location, survey responses, or the contents of messages you send us
B. Information Collected Automatically
When you visit our website, we and our third-party service providers may use cookies, web beacons, pixel tags, log files, and similar technologies to automatically collect:
- Internet and device activity: browser type, operating system, IP address, device identifiers, pages visited, time spent on the website, referring URLs, and your interactions with the website
- Inferences: preferences and characteristics drawn from your activity, which may include demographic inferences
Under California law, information such as IP addresses, device identifiers, and inferences may constitute “personal information” even when it does not directly identify you by name, and we treat it accordingly.
C. Categories Under the CCPA/CPRA
In the preceding twelve (12) months, we have collected the following categories of personal information as defined by the CCPA/CPRA: (1) identifiers; (2) categories of personal information described in Cal. Civ. Code § 1798.80(e); (3) commercial information; (4) internet or other electronic network activity information; (5) approximate geolocation data; and (6) inferences drawn from the foregoing.
Sources: directly from you; automatically from your device; and from our service providers (e.g., payment processors, analytics providers).
Sensitive personal information: We collect account log-in credentials and payment card information solely to provide our services, maintain account security, and process transactions. We do not use or disclose sensitive personal information for purposes of inferring characteristics about you, and we do not use it beyond the purposes permitted by Cal. Civ. Code § 1798.121(a).
2. HOW WE USE YOUR INFORMATION
We may use the information we collect for the following business and commercial purposes:
- Responding to inquiries and processing, fulfilling, and shipping orders
- Providing customer service and support
- Detecting and preventing fraud, security incidents, and other malicious activity
- Delivering content and advertisements, including customized advertisements (see Section 4 regarding your right to opt out)
- Improving website functionality, developing new features, and resolving technical issues
- Conducting data analysis and internal research
- Sending transactional communications and, with your consent where required, marketing communications
- Complying with legal obligations
We will not collect additional categories of personal information or use collected personal information for materially different, unrelated, or incompatible purposes without providing you notice
3. HOW WE SHARE YOUR INFORMATION
We may disclose your personal information in the following circumstances:
- Service Providers and Contractors. With vendors who perform services on our behalf, such as payment processing, order fulfillment and delivery, marketing, analytics, and technical support. These parties are contractually required to use the information only to provide services to us.
- Advertising Partners. With third-party advertising and analytics partners through cookies and pixels for cross-context behavioral (targeted) advertising. Under the CCPA/CPRA, this may constitute “sharing” of personal information. You have the right to opt out — see Section 4.
- Legal Compliance. To comply with applicable law, legal process, court orders, or lawful government requests, or to protect our rights, property, or safety or that of others.
- Business Transfers. In connection with a merger, acquisition, reorganization, or sale of assets, in which case your information may be transferred to the successor entity subject to this Privacy Policy or an equivalent standard of protection.
- Aggregated or De-identified Data. We may share aggregated or de-identified information that can no longer reasonably be used to identify you. We maintain and use de-identified data without attempting to re-identify it.
We do not sell personal information in exchange for money. However, our use of third-party advertising cookies and pixels may be considered a “sale” or “sharing” under the CCPA/CPRA’s broad definitions, and we treat it as such for purposes of your opt-out rights.
In the preceding twelve (12) months, we may have disclosed for a business purpose, or shared for cross-context behavioral advertising, the following categories: identifiers, commercial information, and internet activity information — to the categories of recipients described above.
4. YOUR CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)
If you are a California resident, you have the following rights with respect to your personal information:
- Right to Know / Access. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collection, and the categories of third parties to whom we disclose it.
- Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions (e.g., completing transactions, security, legal compliance).
- Right to Correct. You may request that we correct inaccurate personal information we maintain about you.
- Right to Opt Out of Sale or Sharing. You may direct us not to sell or share your personal information for cross-context behavioral advertising. You may exercise this right through the “Your Privacy Choices” link in our website footer or by contacting us using the methods below.
- Right to Limit Use of Sensitive Personal Information. Because we use sensitive personal information only for the limited purposes permitted by § 1798.121(a), we are not currently required to offer a separate limitation link; if our practices change, we will update this Policy and provide the required link.
- Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights — we will not deny you goods or services, charge different prices, or provide a different level of quality because you exercised your privacy rights.
How to Exercise Your Rights. You may submit a request through either of the following methods:

We will verify your identity before responding, typically by matching information you provide against information we maintain. You may designate an authorized agent to submit requests on your behalf; we will require proof of the agent’s authority and may require you to verify your own identity. We will respond to verifiable requests within forty-five (45) days, with one 45-day extension where reasonably necessary (with notice to you).
Global Privacy Control (GPC). We honor opt-out preference signals such as the Global Privacy Control. When our website detects a valid GPC signal from your browser, we will treat it as a request to opt out of the sale or sharing of personal information for that browser or device.
Shine the Light (Cal. Civ. Code § 1798.83). California residents may request, once per calendar year, information about personal information (if any) we disclosed to third parties for those parties’ direct marketing purposes during the preceding year. Submit requests using the contact information in Section 12.
5. COOKIES, TRACKING, AND DO NOT TRACK
Some features of our website require cookies to function properly. You can manage or disable cookies through your browser settings; however, doing so may limit certain features or functionality of the website. You can also opt out of targeted-advertising cookies via the “Do Not Sell or Share My Personal Information” link, GPC (Section 4), and industry tools such as the Digital Advertising Alliance’s opt-out page.
Third-Party Tracking Disclosure (CalOPPA). Third parties, such as analytics and advertising partners, may collect personal information about your online activities over time and across different websites when you use our website.
Do Not Track. Some browsers transmit “Do Not Track” (DNT) signals. Because there is no uniform industry standard for responding to DNT signals, our website does not currently respond to DNT signals. We do, however, honor the Global Privacy Control as described in Section 4.
6. CHILDREN’S PRIVACY
Our website is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under 13, we will delete it promptly.
We also do not knowingly sell or share the personal information of consumers under 16 years of age. If we ever change this practice, we will first obtain opt-in consent — from the consumer if aged 13 to 15, or from a parent or guardian if under 13 — as required by the CCPA/CPRA.
7. DATA RETENTION
We retain each category of personal information for as long as reasonably necessary for the purposes described in this Policy, determined by criteria including: the duration of your customer relationship with us; our legal, tax, and accounting obligations (e.g., transaction records retained per applicable record-keeping laws); fraud-prevention and security needs; and the resolution of disputes. As general guidelines: account information is retained while your account is active and for a reasonable period thereafter; order and payment records are retained as required by law; and automatically collected browsing data is retained for shorter periods appropriate to analytics and security purposes. When personal information is no longer needed, we delete, de-identify, or aggregate it.
8. DATA SECURITY
We implement physical, administrative, and technical measures designed to protect your personal information, including reasonable security procedures and practices appropriate to the nature of the information as required by Cal. Civ. Code § 1798.81.5. However, no method of data transmission or storage is 100% secure, and we cannot guarantee absolute security. We encourage caution when sharing sensitive information online.
9. ACCESSING AND UPDATING YOUR INFORMATION
You can review and update your account information at any time by logging into your account on our website. Alternatively, you may contact us using the information in Section 12 to request corrections or updates, or exercise your formal correction right described in Section 4.
10. ACCESSIBILITY OF THIS POLICY
We are committed to ensuring this Privacy Policy is accessible to individuals with disabilities. If you have difficulty accessing this Policy, or if you would like to receive it in an alternative format, please contact us using the information in Section 12 and we will provide reasonable assistance.
11. CHANGES TO THIS POLICY
We may revise this Privacy Policy from time to time. The “Effective Date” and “Last Updated” dates at the top of this page indicate when this Policy was last revised. Changes will be posted on this page. For material changes, we will provide reasonable advance notice by posting a prominent notice on the website and/or emailing registered users before the changes take effect. Your continued use of the website after the effective date of a revised Policy indicates your acknowledgment of the revised Policy; where required by law, we will seek your consent to material new uses of previously collected personal information.
